have an orthodontist – who i was supposed to pay 4000 dollars in exchange for Invisalign (the braces) After about a year – i had paid off 3200 of the 4000 – but now i realized i dont like her work and basically she really screwed up my teeth …
i would like to go to a different orthodontist – (who i met with today – he told me he would accept 2000 as a payment for braces – since i already had braces before)
basically – i want to know – if i go by him – do i need to finish paying the rest of the 800 dollars to my other denist? technically – she didnt finish my teeth – so the 4000 was assuming my teeth would be done – she basically only worked on my teeth half way
(i live in michigan – if it makes a different regarding the law)
i want to call her and say ” listen screw off – im NOT paying the 800 dollars i still owe – because technically you didnt finish my teeth – and the complete 4000 was to be paid upon completion of my teeth!”
could i get away with this?

When you started your treatment with Orthodontist #1, chances are good you signed a contract and the office probably gave you a copy of that contract. Legally you are accountable for the agreement you have signed and they can get a lawyer involved and sue you for that remaining $800.00. An Orthodontist can only do so much, if you as a patient, did not comply with the treatment plan, you already broke the contract with your Orthodontist and they cannot be held legally accountable for unfinished treatment.
Legal- wise it will cost you more to fight it than it will to finish paying off what you owe and moving on.

Have a consultation with Orthodontist #2 and see what treatment plan needs to be done, it is difficult to prove malpractice by shaving too much of the interproximal areas of your teeth. Bring your Invisalign retainers to show Orthodontist #2 and see what he thinks of your situation. Take this treatment plan back to Orthodontist #1 (kindly not in attack-mode)showing them that you are serious about finishing treatment, just not with them. Also ask for a copy of your records from Orthodontist #1 to be sent to Orthodontist #2. Orthodontist #1 may forgive the debt. Unfortunately there are too many General Dentists doing Orthodontics and would highly suggest going to an Orthodontist that has completed way more than 15 cases. Hope that helps

You entered into a contract for Invisalign services and probably signed something to that effect. Whether YOU choose to stop treatment or not, the doctor has already paid for all the aligners. No doubt, this is covered in your contract.
A lawyer will tell you that it is difficult to get out of a written contract unless one side fails to live up to their end. If your treatment isn’t satisfactory, have you given your ortho a chance to fix it? Invisalign is highly predictable and I’m surprised that your teeth are “screwed up” that badly.
Since you’ve already invested $3200, why scrap it and start over? Try giving her the chance to finish Invisalign before abandoning treatment.
Attempting to resoved disputes on your own without lawyers is alwasy the best unless you’ve tried and failed already. Lawyers are expensive!
I dont think you can. Even though the job isnt finished I think you still have to pay. Try contacting a lawyer for a free consultation and see what he thinks.
