Can Someone Please Help Me?! – Its Kind Of A Law Question … Thanks So Much In Advance!?

I have an orthodontist – who i was supposed to pay 4000 dollars in exchange for Invisalign (the braces) After about a year – i had paid off 3200 of the 4000 – but now i realized i dont like her work and basically she really screwed up my teeth …
i would like to go to a different orthodontist – (who i met with today – he told me he would accept 2000 as a payment for braces – since i already had braces before)
basically – i want to know – if i go by him – do i need to finish paying the rest of the 800 dollars to my other denist? technically – she didnt finish my teeth – so the 4000 was assuming my teeth would be done – she basically only worked on my teeth half way
(i live in michigan – if it makes a different regarding the law)
i want to call her and say ” listen screw off – im paying the 800 dollars i still owe – because technically you didnt finish my teeth – and the complete 4000 was to be paid upon completion of my teeth!”
could i get away with this?

Legally, you agreed to pay for professional services that were accepted, so you are still legally liable for the $800. If you do not pay this amount the orthodontist can take you to court or, more likely, send your bill to a collection agency who will take you to court. Most medical professionals bundle their outstanding bills to collection agencies.
In court the judge will ask why it took you one year to decide the service was in error and why you did not return to the original orthodontist to see if the problem could be rectified. You will also need to bring the new orthodontist in as an expect witness to testify against the other orthodontist and testify what he did. The new orthodontist will expect an hourly payment for this.
Calling the original orthodontist and telling her to “screw off” is just asking for her to pursue with a lawsuit. A more adult approach would be to contact this person and tell her that you are unhappy with her work, let her attempt to resolve your issues, and if she is unable to resolve the issues negotiate a reduction in the fees that you owe.

also the lawyer might make a deal with you, if you win, he gets 1/3, if you lose, you both get nothing. Its called contingency (I think). Either way, a first meeting with a lawyer should be free for consultation, but make sure first. Don’t screw up your credit rating by simply not paying, it will get you later.

you might want to pay it..or she can take you to court and sue you for the $800+more…hire a lawyer if you really dont want to pay the $800..your dentist could actually at the end..end up paying you more money for screwing up your teeth…word gets out he/she may lose alot of clients..so he/she may want to settle out of court…good luck!
